Terms of Service

Welcome to DataSense AI. These Terms of Service ("Terms") govern your use of the DataSense AI application, operated by TopN Analytics. By accessing or using DataSense AI, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, signing in, or otherwise using DataSense AI, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the application.

2. Description of DataSense AI

DataSense AI is a data-analysis application that helps you analyze structured business data by providing:

• Data quality checks and profiling
• Data visualizations, charts, and dashboards
• AI-assisted business insights and recommendations
• Predictive modeling features
• An optional read-only demo database, and an optional Knowledge Base for reference documents

The application processes data you upload (CSV/Excel files) and, where applicable, uses an AI model (via Ollama, run either locally or through Ollama Cloud depending on deployment) to help plan calculations and generate insights. See our Privacy Policy for details on what is processed and where.

3. User Accounts and Authentication

3.1 Creating an Account

You can create a DataSense AI account with an email address and password, or by signing in with your Google, GitHub, or Microsoft account through our authentication provider, Supabase. You are responsible for providing accurate, current, and complete information when creating your account, and must be at least 18 years old to create one.

3.2 Account Security

You are responsible for maintaining the confidentiality of your password and account credentials, and for all activity under your account. Notify us immediately of any unauthorized access. We are not liable for loss or damage caused by unauthorized use of your account that results from your failure to safeguard your credentials.

3.3 Third-Party Sign-In

If you sign in with Google, GitHub, or Microsoft, your use of that provider's sign-in is also governed by that provider's own terms. We only request the basic profile information needed to create and recognize your DataSense AI account — see our Privacy Policy, Section 4, for details.

4. User Responsibilities and Acceptable Use

You agree to use DataSense AI only for lawful purposes and agree not to:

• Upload, share, or process data containing third-party personal information without proper authorization or consent
• Use the service for illegal activities or to violate applicable laws or regulations
• Attempt to gain unauthorized access to the application, its accounts, or its underlying infrastructure
• Reverse engineer, decompile, or attempt to discover the source code or underlying algorithms of the application
• Use automated tools, bots, or scrapers to access the service
• Interfere with or disrupt the normal operation of the service

DataSense AI is intended for analyzing structured business and analytical data. You are solely responsible for ensuring your use of the service, and the data you upload, complies with applicable laws in your jurisdiction.

5. Uploaded Data and User Content

5.1 Your Data, Your Ownership

You retain all ownership rights to the data you upload to DataSense AI. By uploading data, you grant us a limited license to process, store, and analyze that data solely to provide the service to you.

5.2 How Uploaded Data Is Handled

Uploaded CSV/Excel files are processed in the application's memory to generate analysis and visualizations. If you are signed in and the deployment you are using has database persistence configured, dataset metadata (and, in some cases, the uploaded file itself) may be saved to your account so that saved dashboards can reopen it later — see our Privacy Policy, Section 5, for the exact details.

5.3 Knowledge Base

Documents you upload to the Knowledge Base (PDF, TXT, Markdown, CSV) are indexed for retrieval only within your current session. They are cleared when your session ends or when you click "Clear" in the Knowledge Base settings, and are not saved to any persistent database.

5.4 Correction Feedback

If you correct an analysis result, that correction may be stored and reused on future analyses of similarly-structured datasets, as described in our Privacy Policy, Section 6.1. Do not include personal or confidential information in free-text corrections that you would not want reused in this way.

6. AI-Generated Results and Limitations

DataSense AI uses an AI model (via Ollama) together with deterministic calculations to generate insights, visualizations, and recommendations. While we aim for accuracy:

• AI-generated insights are interpretations, not guarantees.
• All calculations are based on the data you provide; incorrect or incomplete input data will produce incorrect or incomplete results.
• You are responsible for independently verifying any insight or recommendation before relying on it for business decisions.
• We make no warranty regarding the accuracy, completeness, or reliability of any AI-generated content.

7. Third-Party Services

DataSense AI relies on the following third-party services to operate:

7.1 Supabase

Supabase provides authentication, our Postgres database, and file storage used for accounts, saved datasets, dashboards, chat history, usage analytics, and contact-form enquiries. Supabase operates under its own terms of service and privacy policy.

7.2 Ollama / Ollama Cloud

The AI model that interprets your questions and plans calculations runs via Ollama, either locally within the deployment environment or, where configured, through Ollama Cloud. If Ollama Cloud is used, that processing is also subject to Ollama's own terms.

7.3 Resend

If you submit the "Contact TopN Analytics" form, we use Resend to send a best-effort notification email to our team, containing only the form fields you submitted.

7.4 Google / GitHub / Microsoft

If you sign in with Google, GitHub, or Microsoft, your use of those sign-in options is governed by their respective terms, in addition to these Terms.

You are responsible for ensuring your use of any third-party service integrated with DataSense AI complies with that service's own terms and policies.

8. Intellectual Property

8.1 Our IP

DataSense AI, including its design, code, features, and functionality, is the intellectual property of TopN Analytics. You may not copy, modify, distribute, or use any part of the application without explicit permission.

8.2 Your Data

You retain all intellectual property rights to the data you upload and analyze through the application, subject to the limited license in Section 5.1.

9. Service Availability

DataSense AI is provided on an "as-is" basis. We do not guarantee uninterrupted availability or error-free operation. We may perform maintenance that temporarily suspends the service, update or modify features, or discontinue the service at any time. We will use reasonable efforts to provide notice of planned maintenance.

10. Disclaimer of Warranties

DataSense AI is provided "AS IS" without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including of merchantability, fitness for a particular purpose, non-infringement, and warranties regarding accuracy, completeness, or reliability of results (including AI-generated results). We do not warrant that the application will meet your needs or be error-free.

11. Limitation of Liability

To the fullest extent permitted by applicable law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of DataSense AI.
• Our total liability for any claim relating to the service shall not exceed the amount you paid for the service, if any.
• Some jurisdictions do not allow certain limitations of liability, so these limits may not apply to you.

12. Account Suspension or Termination

12.1 Reasons for Suspension

We may suspend or terminate your account if you violate these Terms, engage in illegal or abusive behavior, or if we determine it is necessary to protect our service or users.

12.2 Upon Termination

Upon termination, your right to use the application ceases immediately. Deletion of your account and associated data is handled as described in our Privacy Policy, Section 11 — currently a manual process on request, not an automated in-app flow.

13. Data Deletion

Within the application, you can delete a saved dashboard yourself at any time. Deleting other saved data (uploaded datasets, chat history) or your account is not currently self-service; contact us as described in Section 15 and in our Privacy Policy to request deletion.

14. Changes to the Terms

We may modify these Terms at any time. Changes take effect upon posting to the application. Continued use of DataSense AI after a change constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Mumbai, India, without regard to its conflict-of-law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Mumbai, India.
